Minutes of February 19, 2009, telecom-board meeting

Telecommunication Board Meeting Minutes
February 19, 2009
Room 219, 113 West Mountain
5:30 p.m.

Board members present were Sales, Graves, Shepherd, Hilton and Mayes. Also in attendance: University Of Arkansas Television (UATV) Station Manager Dan Phillips, and Community Access Television (CAT) Manager Sky Blaylock.
Approval of January 15, 2009 Minutes
Graves moved to approve the minutes.
The second was unidentified and the motion passed.
Adoption Of The Agenda
Sales moved to adopt the agenda
Graves seconded the motion.
The motion passed.
UATV Television Report
Station manager Dan Phillips reported that the station is seen 126 hours a week with six hours a week as first run, original programming.
The station has one new program, Beyond the Sound Bite, a one-hour long panel discussion with the first topic being illegal immigration.
They also have a new import from Drexel University that is 30 minutes long.
UATV recently installed a new audio board and are close to having all programming on the internet at uatv.uark.edu
Fayetteville High School is airing their Friday basketball games live.
UATV is currently aired in Springdale, Rogers and Bentonville as well as Fayetteville on channel 14.
Mayes expressed his appreciation for UATV’s flexibility allowing FHS to air the games.
Phillips said the UATV contract with the City is unsigned because it is thought to be out of date and not representative of the station. He said revisions were made and sent back to the City but with Dr. Thomas leaving last December, it is uncertain where those revisions are. UATV however, is willing to continue negotiating the contract should the City wish.
Graves moved to gather the information on the suggested changes to the UATV contract for board review and recommendation on how the City might proceed.
The second was unidentified.
The motion passed

AT&T U-verse
Hilton said that AT&T’s information on this service mentions a site visit and wondered if it has happened or if it is planned. Hilton also noted that the U-verse agreement with AT&T states there is supposed to be an annual report by AT&T about the service.

Blaylock said the Alliance for Community Media has followed U-verse and found PEG channels are not available to everyone who subscribes, Peg channels are in an inferior channel (99) spot and it is documented that AT&T has bypassed local franchising authorities in many places.
Hilton also asked if written notice has been received that AT&T has the capability to provide technical access.

Shepherd said he would send a written request for a report on the items Hilton mentioned.

Cox Communications Report
Shepherd said Cox was invited to the meeting but was unable to attend but will again invite them to the March meeting.

CAT Report
Blaylock reminded the board of the Community Media Summit March 27 & 28, 2009 and added that CAT got an $8,000 grant from the Benton Foundation. She said they are seeking access channels outside the region as there are so few within the region. Lastly, she said the FAT CAT awards will be awarded during the summit.

Shepherd suggested to Blaylock that the Short Take program be not recorded on re-recordable DVDs as appearances could be taped over and unseen due to something like the recent January power outage.

Blaylock agreed and will change the practice at CAT.

Compliments
None

Complaints
Shepherd read the AT&T response to a previous complaint about the availability of
U-verse service in Fayetteville.

Hilton suggested that the board vote on whether complaints are adequately addressed.

Mayes suggested that when AT&T reports to the board they give an update on the rollout of U-verse in Fayetteville.

Hilton moved that they approve the response to the complaint.

The second was unidentified.

The motion passed.

Subcommittee Report on Forum Planning
Hilton said that Walt Eilers will be the moderator of the February 24, 2009 forum on the Governance of the Government Channel. He said and that there has been no word from the Mayor’s office on having a representative there and the City Attorney has said he is not available. Participants will be
Angie Graves, Telecom Board member
Fred Cusanelli, Telecom Board member
Andy Mayes, Telecom Board member
Marvin Hilton, Telecom Board member
Aubrey Shepherd, Telecom Board Chairman
Jim Bemis, Citizen Representing Complainants

Hilton read the list of questions formulated by the subcommittee.

1. Which City of Fayetteville entities shall have administrative responsibility for recommending and implementing the Fayetteville Government Channel Policy and Procedures?

Hilton moved to accept this question for the forum.
Graves made the second.
The motion passed.

2. What are the formal working relationships between the City Council, Telecommunications Board and the City Staff as established by City ordinances?

Hilton moved to accept this question for the forum.
Graves made the second.
The motion passed.

3. What is the definition of “policy” and what is the definition of “procedure”?

Hilton moved to accept this question for the forum.
Graves made the second.
The motion passed.

4. Which of the following entities, City Council, Telecommunications Board, or City Staff has “ownership” and legal responsibility for the FGC policies and procedures?

Hilton moved to accept this question for the forum.
Graves made the second.
The motion passed.

5. Which of these entities (mentioned in question #4) define the “policy” and “procedures” that apply to the Fayetteville Government Channel and other PEG Center electronic media facilities?

Hilton moved to accept this question for the forum.
Graves made the second.
The motion passed.

6. What are the reasons for having issue forums on the Government Channel that are requested by citizens?

Hilton noted that the complaint that this forum came from was that the process was not properly followed in constructing the new policy.

Graves thought this last question should not be asked at the February 24 forum.

Mayes agreed as did complainant Jim Bemis.

Mayes moved to omit question #6 from the forum.
Graves made the second.
The motion passed.

Hilton asked that since the forum will take place within the context of a TCB meeting should the board allow votes to be taken.

Mayes said that was discussed in the forum planning meeting and it was decided that no votes would be taken.

Graves agreed that the special board meeting would not be merged with official business.

Hilton asked how they planned to use the information that comes out of the forum.

Shepherd said the notes of the forum will give them ideas for board motions.

Graves said she hoped they would get to some working relationships, protocol and process between the entities. To that end, she suggested re-inviting the City Attorney’s office, and a representative of the Mayor’s office and City Council.

Mayes agreed and said at least they should get written responses to the questions.

Bemis also agreed that dialogue is needed.

Shepherd stressed the desire for public input at the February 24th forum either in person, by phone or email as it will be aired LIVE.

Internet Subcommittee Report
Shepherd asked for a volunteer or nomination to chair the subcommittee as former member Bell was the chair but is no longer a board member. He has the DVDs of the three subcommittee meetings for the new chair to review in order to get up to speed. He added that the subcommittee does not need to meet before the March TCB meeting.
Other subcommittee members are Bemis, Shepherd, Ward 2 Alderman Petty, and CAT Board Vice Chair Leaf.

Mayes volunteered to chair the committee as long as it is not a committee of one.

An informal voice vote was in favor of Mayes as Internet Subcommittee chair.

Policy & Procedures Subcommittee Report
Hilton suggested that any further work in this subcommittee should follow the February 24th forum and the yet to be scheduled brainstorming session.

Graves and Bemis agreed.

Hilton suggested roundtable seating at the PEG Center studio for the brainstorming session.

Bemis suggested the board discuss and define what a brainstorming session is since it is not mentioned in the policy & procedures.

Mayes said the nature of a brainstorming session is unstructured and moved that the session be scheduled before the March 19 TCB meeting if possible.

Hilton suggested that the brainstorming session should follow the March TCB discussion of the February 24 forum.

Mayes suggested the board address all the outstanding items of the Bemis complaint before they attempt to take any action.

Graves agreed.

It was then decided to tape the session for replay on the City 16 channel.

Hilton made the second to Mayes motion.

The motion passed.

Shepherd said he would make the reservation “at the CAT studio.”

Old Business
Bemis suggested that his complaint dated Nov 17, 2008 be taken up at the next Policy & Procedures Subcommittee for resolution.

New Business
Bemis referred to a Mayes comment of how the city can get more bandwidth for another education channel. He claimed AT&T and Cox could provide it with the switch to digital television.

Mayes said the school system would like an additional channel but the board should deal with current issues before considering an additional channel.

Citizen Comment
Shepherd said he thought this a useful agenda item and so added it.

Agenda For March Meeting
Hilton suggested the UATV contract and AT&T U-verse update.

Graves suggested reports from the forum and brainstorming session.

Bemis suggested the board send a representative to the Community Media Summit in March.

Adjournment
With no additional agenda items or discussion, Shepherd declared the meeting adjourned at approximately 7:10 p.m.

AT&T U-versesm TV

AT&T U-verseSM brings consumers a revolutionary
new entertainment experience. AT&T is the only
national provider to offer a 100-percent Internet
Protocol (IP)-based video service, AT&T U-verse
TV, which delivers a new level of service
integration and features that are unmatched in
the marketplace.

AT&T U-verse TV offers customers a compelling
variety of TV and Internet packages to customize
their entertainment experience. AT&T customers
can choose from five basic TV packages – U100,
U200, U300 and U400 – and a unique family-
friendly programming package, U-family, which
includes the best family-oriented TV channels.

AT&T’s service also includes video-on-demand
titles for all ages as well as offering a variety of
flexible HD, movie, sports, and Spanish language
programming options.

AT&T’s PEG Solution

AT&T is committed to carrying Public, Educational
and Governmental (PEG) programming over its
AT&T U-verse TV service. Because AT&T’s U-verse
service is based on IP, AT&T will use IP streaming
capability to deliver PEG channels.

AT&T will have no role in the acquisition or
creation of the PEG content, nor will it exercise
any production or editorial control over the
content. The PEG programming provider will be
responsible for all PEG content, including the
acquiring of any appropriate rights and licenses
necessary to allow transmission by AT&T
throughout the designated market area (DMA)
and ensuring viewer suitability of content.

“Live PEG Streams”

PEG programming content must be converted to
a streaming video signal for transmission on
AT&T’s U-verse platform. The format is Microsoft
Windows Media 9, encoded at 1.25 Mbps per
stream/channel with a resolution of 480x480.
More detailed technical specifications will be
provided upon request.

User Experience

AT&T U-verse TV’s PEG service gives customers
more choices – they can choose to watch
programming provided by their own community
as well as other participating communities within
the surrounding area, or DMA. Similarly, a PEG
provider’s programming is available to not just
customers within their own community, but to all
AT&T U-verse TV customers in the DMA.

AT&T has designated Channel 99 as the location
on its U-verse channel guide dedicated
exclusively to PEG programming. Customers can
access the PEG application in a number of ways:
by selecting “Government, Education and Public
Access” from the “Live TV” section of the Main
Menu; by accessing the “Guide” and scrolling to
Channel 99; or simply by entering “99” on the

2007 forum dealing with the proposed contract with AT&T excellent on Sunday and to run again Friday on CAT 18

From Richard Drake's Street Jazz blog:

2007 AT&T forum - the Promise and the Reality?

In early 2007, Fayetteville held a public forum dealing with the proposed contract with AT&T. The forum, which was put together by the Telecomm Board, featured representatives from AT&T, local government, the Telecomm Board, and members of the community.
Many members of the community were contacted for input, when putting together questions for the forum.
Now, when many members of the public seem concerned about AT&T's u-verse - particularly as it relates to PEG programming - it may be time to revisit that forum, and hear the concerns raised by the public, and the responses and reassurances given by those from AT&T.
The forum will be replayed on Community Access Television on Friday (7:30pm).
C.A.T. is shown on Channel 18 of the Cox Channel line-up in Fayetteville
Those outside the Fayetteville viewing area can see the program online at: www.catfayetteville.org
Programs shown on the website are seen at the same time as they are shown on C.A.T.
rsdrake@nwark.com

I watched most of the replay of that old forum last night and Richard is correct about its importance and relevance now.
Thursday's Telecom board meeting agenda includes a brief report on the U-verse situation and public comment will be welcome at 5:30 p.m. in the council chamber at city hall.

The following Tuesday, February 24, a forum sponsored by the Telecom board in the same room begins at 6:30 p.m. with discussion of some residents' complaints to be the focus. Everyone is welcome to attend and speak at these meetings. And both email and telephone access will be provided during the meetings. Also, both meetings are to be available online through the city's Web site. For more information and updates, please use the Fayetteville Government Channel Web log link on the right side of this page.

Minutes of January 15, 2009, telecom-board meeting

Telecommunications Board Meeting Minutes
January 15, 2009
Room 219, 113 West Mountain
5:30 p.m.

Board members present were Sales, Cusanelli, Graves, Shepherd, Hilton and Mayes. Also in attendance: Community Access Television (CAT) Manager Sky Blaylock.

Election Of A New Chair
Vice Chairman Sales opened the meeting and asked for nominations for chair.

Cusanelli nominated Aubrey Shepherd.

Hilton made the second.

The vote was unanamous in favor of the motion.

Chairman Shepherd asked that board member Cusanelli act as parliamentarian.

Hilton suggested that the chair ask for additional comments each time before moving onto other agenda items. It was hoped by Hilton that this would avoid interruptions.

Shepherd welcomed new board member Andrew Mayes.

Approval of November 20, 2008 Minutes

Hilton noted an error on page two; the word “compliant” should be “complaint”

Graves moved to approve the minutes as amended.

The second was made by Cusanelli and the motion passed.

City 16 Television Report
Shepherd read the written report submitted by City 16 TV Station Manager and Public, Education and Government (PEG) Center Office Coordinator Ric delaHoussaye.

Hilton asked if the noted change to dimmable fluorescent lights was through out the building.

Blaylock said it was just in the control room and the editing suites but there are plans to change out the studio lights in the future.

Cusanelli moved to accept the report.

Graves seconded the motion.

The motion passed.

CAT Report
Blaylock distributed flyers promoting the community media summit in March, the planning of which is on-going. She then gave a demonstration of CAT channel 18 being web streamed and said it could be found on the web at catfayetteville.org. She complimented University of Arkansas work study student Flint Woods on his work to bring this to fruition. In addition, she thanked the Northwest Arkansas Community Foundation and the City of Fayetteville for the funding they have provided CAT.

Shepherd asked if any of the programming would be archived for on-demand playback.
Blaylock said not currently but that is a possibility. Other features of the new site are an online dub request form and registration forms for workshops.

As a side note, Shepherd warned that the one year time limit on city meetings on granicus is about to expire for January 2008.

Compliments
Shepherd read a complimentary email to City 16 from former City Alderman Nancy Allen. A second compliment from United Way was read thanking the Cable Administration staff for their financial support in the City’s fund drive.

Complaints
Three resolved complaints concerning Cox were read.

One complaint regarding AT&T U-verse that has yet to be addressed was read.

Cusanelli explained that AT&T is working on getting its U-verse service to all of Fayetteville and asked that would-be subscribers be patient with the process. He added that the channel lineup can be found at www.att.com. He noted that the religious channels are on the lowest subscription tier and soon the PEG channels will be available. He added that for those subscribers on the fringe area, the PEG channels will be available on Dish Network.

Discussion Of The Forum And Brainstorming Session
This is in regards to the Jim Bemis complaint about an alderman’s request for forums that were denied by the previous city administration.

Hilton suggested a planning session to move forward on this. A committee consisting of Bemis, Hilton, Shepherd and Graves was self selected to do this and noon Monday, January 26 at the PEG Center was chosen.

Shepherd said Hilton will coordinate this with an agenda. It is an open meeting for the public and will be taped by City 16. He added that the City 16 policy inconsistencies that need to be remedied will be part of the discussion in both the forum and the brainstorming session.

Citizen Jim Bemis then addressed the board, welcomed Mayes and complimented CAT on the web streaming of its programs.
Concerning his previously filed complaint he said the purpose was “to have a complete complaint process.” He said he sees the forum and brainstorming session as a discussion of the roles, responsibilities and jurisdiction of the TCB, the city council and the city administration concerning the legal obligations and administrative responsibilities for the development and interpretation of the Fayetteville Government Channel policies and procedures. This would establish who is in charge Bemis said. In addition, he mentioned the April 2008 Forum on Forums and the unaddressed agenda items that still need to be thought out.

Graves said the issues Bemis raised were to be discussed in the forum but not in the January 26 planning meeting.

Hilton asked for forum participants from the board.

Cusanelli and Shepherd said they would participate.

Mayes said he might.

Old Business
Shepherd read the suggested changes to the City 16 message board metric.

Hilton said that since this is a performance measure it should be voted on and moved to accept the change.

The second was unidentified.

The motion passed.

New Business
Hilton suggested and moved to have LIVE phone-in and email participation in future TCB meetings to encourage public participation.

The second was made by Graves

The motion passed.

Bemis asked that his November 17 request/complaint concerning the policy and procedures subcommittee be taken up by the board at their next meeting.
He claimed this is a new, separate complaint as he did not meet the time requirements on a former complaint.

Graves sought a summary statement in the November 17 Bemis document and settled on the complaint being about how the board arrived at the new policy.

Bemis agreed with her.

Adjournment
Sales moved that the meeting adjourn.

Graves made the second.

The motion passed and the meeting was adjourned at approximately 6:50 p.m.

If necessary, removal action will be taken at the next regular meeting of the Board, with notification sent to the City Clerk. The Board, in the event of a dispute and upon written petition, may resolve all questions finally as to activity, standing, and tenure, subject only to appeal to the City Council.

Published schedule not being followed today

Government channel is not following the schedule published today on this Web log or in today's Living Section of the Northwest Arkansas Times. This is probably a technical problem and is not the fault of the scheduler or of the newspaper.
When the staff is at work Monday, the station likely will be put on schedule again very quickly.
Cancel what I said about The Times not having a valid guide in Sunday's
paper. They are going the extra mile for us. Thanks to them.
